Terms and conditions of HSBC TravelSafe Programme (1) This Programme runs from 01 January 2007 to 31 December 2007 ("Programme Period"). (2) HSBC's TravelSafe Programme is underwritten by Mitsui Sumitomo Insurance (Malaysia) Bhd (46983-W) ("MSI") (3) Only Credit Cardholders ("Eligible Cardholders") which are issued by banks licensed under the Banking and Financial Institutions Act 1989 (BAFIA) are eligible to take up this Programme for themselves and their direct family members and the same is not transferable. For the avoidance of doubt, direct family members are limited to legal spouse and children, including legally adopted children between 1 month and 18 years old. (4) Eligible Cardholders must ensure their HSBC credit card is current and not delinquent in anyway when applying for HSBC's TravelSafe under this Program. (5) Other criteria for eligibility of cover include:(a) Age limit of up to 80 years old to be eligible for full coverage under all plans except for Annual Cover, where age limit is 60 years old. Partial coverage is applicable for children between 1 month and 18 years old for death benefits of up to RM25,000-00. (b) Must be Malaysian, Malaysian Permanent Resident or work permit holders legally employed in Malaysia (c) Covers both business and leisure trips (d) Chartered flights are not eligible for Flight Delay cover (e) Each trip must begin & end in Malaysia except for One Way Cover. For One-Way trips, the coverage will terminate 72 hours arrival (f) An overseas trip shall involve return to Malaysia within the period of insurance and in no event exceed 185 days from the date of departure. For overseas trips in excess of 185 days, the coverage will only be limited to 185 days from the date of departure. For Annual Cover, coverage is limited to the first 90 days from date of departure. (6) By submitting this TravelSafe application, the applicant hereby authorises the Bank to submit his or her details to Mitsui Sumitomo Insurance (Malaysia) Bhd ("MSI") any information pertaining to this TravelSafe application. In consideration of the Bank acting on this authorisation, the applicant irrevocably agrees to waive any right to claim/redress he/she may have against the Bank as a result of the Bank carrying out this arrangement. (7) Subject to clause 11 below, eligible cardholders will receive a call from MSI informing them of the outcome of their application, and if deemed successful will receive their certificate of insurance number. (8) The following general policy exclusions apply: (a) War & related risks (b) Government Regulations or Acts or Authorities of any country (c) Hazardous adventure (d) Suicide, self-inflicted injury or illness (e) The effect or influence (temporary or otherwise) of alcohol or drugs (f) AIDS, AIDS-related complex and sexually-transmitted diseases (g) Pre-existing medical conditions (h) Pregnancy, childbirth, abortion or miscarriage (i) Illness or disorders of a psychological nature, any anxiety state and/or nervous depressions and mental illness (j) Manual work in connection with any trade, employment or profession (k)Travelling in an aircraft (other than as a passenger) in a fully licensed passenger-carrying aircraft and for no other purpose (l) Any extension of cover is not allowed during the trip or after having departed for destination. (m) No cancellation or refund of premium is allowed once the certificate of insurance is issued. (n) The descriptions of cover and general exclusions are a brief summary for easy reference. The full terms and conditions that apply are in the policy. (9) Payment(s) must be made via credit cards issued by banks licenced under BAFIA only. Other types of cards such as charge cards and debit cards whether issued by financial institutions incorporated in Malaysia or overseas cannot be used to purchase HSBC TravelSafe. (10) Plan must be purchased at least 2 working days before time of departure. (11) This Programme is given to Eligible Cardholders based on their present credit status. Approval or rejection of this TravelSafe application is subject to the conduct of the Eligible Cardholders' HSBC will not be held responsible and/or liable for payment rejection made by other credit card issuers resulting in the rejection of the TravelSafe application. For purchases made with HSBC Credit Cards, all other terms and conditions relating to the usage of HSBC Credit Cards as appearing in the Cardholder agreement shall apply. (12) This product is not an obligation of, deposit in or guaranteed by HSBC Bank Malaysia Berhad. (13) HSBC is neither underwriter nor broker for the customer. To the fullest extent permissible pursuant to applicable law, HSBC makes no warranties or representation as to the accuracy, correctness, reliability or otherwise of the content of this marketing material. Under no circumstances, including, but not limited to negligence, shall HSBC or any party involved in creating, producing or delivering the marketing material be liable to the Eligible Cardholder for any direct, incidental, consequential, indirect, or punitive damages that result from the use of, or the liability to use, the information in these marketing materials even if HSBC may have been advised of the possibility of such damages. 14) HSBC will receive a commission from MSI in respect of this transaction. HSBC is not the supplier of the products and services and will not accept liability in relation thereto. (15) HSBC reserves the right to cancel, terminate or suspend this Program with or without any prior notice. For the avoidance of doubt, cancellation, termination or suspension by HSBC of this Programme shall not entitle the Eligible Cardholder to any claim or compensation against HSBC for any and all losses or damage suffered or incurred by the Eligible Cardholder as a direct or indirect result of the act of cancellation, termination or suspension. (16) HSBC reserves the right at its absolute discretion to amend, delete or add to any of these Terms and Conditions from time to time without prior notice. (17) These Terms and Conditions, as the same may be amended from time to time shall prevail over any provisions or representations contained in any other promotional materials advertising this Programme. (18) In the event of a conflict between English and translated versions of these Terms and Conditions, the English version shall prevail. |
